1. Who we are

These terms apply to all services provided by Indivision. By purchasing a website build or subscribing to a website plan, you agree to these terms.

2. Our services

We provide three types of service:

• Once-off website builds: we design and build a website for you, which you own on full payment.
• Website subscription plans: a monthly plan that covers your website build, hosting, domain, maintenance, and a monthly allowance of small changes.
• Annual care plans: an optional yearly plan for once-off build clients. A single payment once a year keeps your website hosted, renews your domain, and covers security, with no monthly commitment.

All prices are quoted and billed in South African Rand (ZAR).

3. Payment terms

Once-off builds: 50% deposit before work begins, and the remaining 50% before the website goes live.

Subscription plans: billed monthly in advance via recurring billing through Paystack. Your subscription remains active for each month you have paid for.

Annual care plans: billed once a year in advance via recurring billing through Paystack. The yearly fee covers your domain renewal, hosting, and administration for the coming year, and renews automatically until you cancel.

4. Subscription terms

• There is no lock-in period. You can cancel at any time directly from your client dashboard.
• Your monthly fee includes hosting, your domain, security and maintenance, access to your client dashboard with your website analytics, and a set monthly allowance of small changes as specified in your plan.
• Dashboard access ends when your subscription ends. You may request an export of your website analytics data when leaving.
• Under a subscription, your website is provided as a service. You do not own the website code unless you purchase it (see section 7).
• If you cancel, your website stays online until the end of the billing period you have paid for, and is taken offline the day after that period ends. For example, if you have paid for June and cancel during June, your website goes offline on 1 July.

5. Included changes

Your subscription includes a monthly allowance of small changes, such as:

• Editing text, prices, business hours, or contact details
• Swapping or adding images
• Adding a testimonial or review

The following are not included and are quoted separately before any work begins:

• New pages or new sections
• New features, functionality, or integrations
• Redesigns or significant layout changes

Unused changes do not roll over to the next month.

6. Annual care plans

An annual care plan is an optional add-on for once-off build clients who want us to keep their website online without a monthly subscription. One yearly payment covers:

• Hosting for your website for the year
• Renewal of your domain
• Security and uptime monitoring

• The annual fee is billed once a year in advance and renews automatically through Paystack until you cancel.
• You still own your once-off website code (see section 7). The care plan is a service that keeps it hosted and its domain renewed; it does not change who owns the code.
• Annual care plans do not include content changes or new work. Those are quoted separately, the same as for any once-off client.
• You can cancel at any time by emailing us. Your website and domain stay active until the end of the year you have paid for, and are taken offline after that.
• If the annual fee is not paid by its renewal date, your domain is not renewed and your website goes offline.

7. Ownership

Domains: for subscription and annual care plan clients, Indivision registers and manages your domain as part of the service. If you cancel, you may request that your domain be transferred to you, at your cost.

Website code: for once-off builds, ownership of the website code transfers to you on full payment, on request. For subscription plans, the website code remains the property of Indivision.

Buy-out: subscription clients may request to purchase their website outright at any time. This is quoted individually.

Handover: because you already own your once-off website code, if you leave an annual care plan you may request a copy of your website files so you can host it elsewhere. We will provide the files once your account is settled. Moving the site to a new host, and any setup work involved, is your responsibility, and we can quote to assist if you would like our help.

8. Delivery

All services are delivered digitally. Build timelines are agreed per project and depend on you providing the required content (text, images, logos, and business details). Delays in providing content will delay delivery.

9. Revisions

The number of revision rounds included in your build is specified in your quote or plan. Additional revision rounds are billed separately at our standard rate.

10. Cancellation

Subscription clients can cancel at any time directly from their client dashboard, with immediate effect and no notice period. You can also cancel by emailing info@indivision.co.za. Cancellation stops future billing, and your subscription ends at the end of your current paid billing period.

11. Payment security

Online payments are processed by Paystack, a secure payment provider. All payment pages are secured with SSL encryption. No card details are stored on this website. For more information visit paystack.com.

The merchant outlet country at the time of presenting payment options is South Africa. Transaction currency is South African Rand (ZAR).

12. Limitation of liability

• Our services depend on third-party providers, including hosting providers, domain registrars, payment processors, and analytics services. Indivision is not liable for outages, failures, or changes caused by these third parties.
• Indivision is not liable for any indirect or consequential loss, including loss of profits or loss of business, arising from website downtime, errors, or interruptions.
• Indivision's total liability to you is limited to the fees you paid to us in the three months preceding the claim, or, for once-off builds, the project fee paid.
• You are responsible for the accuracy and legality of all content you supply for your website.

These terms are governed by the laws of South Africa, and any disputes will be handled in South African courts.

14. Changes to these terms

We may update these terms from time to time. The latest version will always be available on this page. Continued use of our services after an update means you accept the updated terms.
