1. Who we are

These terms apply to all services provided by Indivision. By purchasing a website build or subscribing to a website plan, you agree to these terms.

2. Our services

We provide two types of service:

• Once-off website builds: we design and build a website for you, which you own on full payment.
• Website subscription plans: a monthly plan that covers your website build, hosting, domain, maintenance, and a monthly allowance of small changes.

All prices are quoted and billed in South African Rand (ZAR).

3. Payment terms

Once-off builds: 50% deposit before work begins, and the remaining 50% before the website goes live.

Subscription plans: billed monthly in advance via Payfast recurring billing. Your subscription remains active for each month you have paid for.

4. Subscription terms

• There is no lock-in period. You can cancel at any time directly from your client dashboard.
• Your monthly fee includes hosting, your domain, security and maintenance, access to your client dashboard with your website analytics, and a set monthly allowance of small changes as specified in your plan.
• Dashboard access ends when your subscription ends. You may request an export of your website analytics data when leaving.
• Under a subscription, your website is provided as a service. You do not own the website code unless you purchase it (see section 6).
• If you cancel, your website stays online until the end of the billing period you have paid for, and is taken offline the day after that period ends. For example, if you have paid for June and cancel during June, your website goes offline on 1 July.

5. Included changes

Your subscription includes a monthly allowance of small changes, such as:

• Editing text, prices, business hours, or contact details
• Swapping or adding images
• Adding a testimonial or review

The following are not included and are quoted separately before any work begins:

• New pages or new sections
• New features, functionality, or integrations
• Redesigns or significant layout changes

Unused changes do not roll over to the next month.

6. Ownership

Domains: for subscription clients, Indivision registers and manages your domain as part of the service. If you cancel your subscription, you may request that your domain be transferred to you, at your cost.

Website code: for once-off builds, ownership of the website code transfers to you on full payment, on request. For subscription plans, the website code remains the property of Indivision.

Buy-out: subscription clients may request to purchase their website outright at any time. This is quoted individually.

7. Delivery

All services are delivered digitally. Build timelines are agreed per project and depend on you providing the required content (text, images, logos, and business details). Delays in providing content will delay delivery.

8. Revisions

The number of revision rounds included in your build is specified in your quote or plan. Additional revision rounds are billed separately at our standard rate.

9. Cancellation

Subscription clients can cancel at any time directly from their client dashboard, with immediate effect and no notice period. You can also cancel by emailing info@indivision.co.za. Cancellation stops future billing, and your subscription ends at the end of your current paid billing period.

10. Payment security

Online payments are processed by Payfast, a secure South African payment gateway. All payment pages are secured with SSL encryption. No card details are stored on this website. For more information visit payfast.io.

The merchant outlet country at the time of presenting payment options is South Africa. Transaction currency is South African Rand (ZAR).

11. Limitation of liability

• Our services depend on third-party providers, including hosting providers, domain registrars, payment processors, and analytics services. Indivision is not liable for outages, failures, or changes caused by these third parties.
• Indivision is not liable for any indirect or consequential loss, including loss of profits or loss of business, arising from website downtime, errors, or interruptions.
• Indivision's total liability to you is limited to the fees you paid to us in the three months preceding the claim, or, for once-off builds, the project fee paid.
• You are responsible for the accuracy and legality of all content you supply for your website.

These terms are governed by the laws of South Africa, and any disputes will be handled in South African courts.

13. Changes to these terms

We may update these terms from time to time. The latest version will always be available on this page. Continued use of our services after an update means you accept the updated terms.
